BOOKING TERMS & CONDITIONS

MODES OF PAYMENT

The tour prices are quoted in Malaysian Ringgit (MYR) and are subject to 6% Goods & Service Tax (GST) charges.

We accept payment by cash, cheques and interbank funds transfer (all administrative back charges to be borne by client).

All rates are valid at the time of publication and are subject to change without notice. Please bank-in or TT to our appointed company bank account(s) and fax/email us the bank-in (TT) slip for our reference.

RESERVATION DEPOSIT & PAYMENT TERMS 

For instant booking, immediate confirmation will be issued for your reservation upon successful online payment transaction.

For non-instant booking, the reservation can only be held for 3 days from the date of issue of client invoice (unless otherwise stated). A deposit of 50% of the total tour price is required to secure booking (climbing slots / accommodation / tour packages / all other bookings) . No reservation will be considered as confirmed without the payment of a deposit. Full payment in Malaysian Ringgit (MYR) must be received 30 days before arrival. Should reservation be made less than 30 days before arrival, full payment must be received immediately upon confirmation of reservation. Failing to comply with this condition may result in cancellation of all reservations without prior notice. All bookings are subject to availability at the time of booking.

For booking at exhibitions / events, client got to make a deposit payment of Malaysian Ringgit (MYR) 100 per person for all participants that would like to join the tour and to secure the promotion price (valid for 1 year) for the package that has been selected. After reservation has been confirm, client got to make the second deposit of 50% of the total tour price to secure booking (climbing slots / accommodation / tour packages / all other bookings) within 3 days from the date of issue of client invoice.   

CANCELLATION POLICY

In the event of cancellation of booking by Client, a written notice must be provided. The following cancellation charges must be borne by the Client and the travelling companions as follows:

Number of days between tour commencement and receipt of cancellation notice:

    • 45 days or more (50% of tour cost)
    • 30 to 44 days (60% of tour cost)
    • 15 to 29 days (75% of tour cost)
    • 08 to 14 days (85% of tour cost)
    • 06 to 07 days (95% of tour cost)
    • Less than 05 days or No Show (100% of tour cost)

For tour products or individual components supplied by 3rd parties, e.g. Hotel/Lodge Bookings, etc, cancellation fees under the terms and conditions of the respective 3rd parties shall apply plus a minimum handling charge of MYR50 per service per person.

RESERVATIONS & CONFIRMATION

All reservations (Tour Packages) must be made at least 30 days before departure. Note that all packages are required to travel with 2 Adults. For single traveller, please contact us for more information.

Flight reservations to Kota Kinabalu are solely the responsibility of our guests and confirmation must be made beforehand.

Reply will be by a confirmation of services through fax, email or whatsapp within three working days. This confirmation will also serve as pro forma invoice.

For bookings at exhibitions / events, client got to make a deposit payment to secure the promotion price (valid for 1 year) for the package that has been selected. When client has made the second deposit of 50% of the total tour price, it indicates that client has agreed with all terms and conditions and have read through the terms.

Mountain Climbing Packages:-

Note that all climbers MUST send all documents (eg: I/C or passport) requested by Borneo Land Adventures Sdn.Bhd. in order to confirm your climbing slot immediately once booking is confirm. Fail to do so within 12 hours from confirmation (time & date), booking will be release immediately without notice.    

REFUNDS

Mountain Climbing Packages:-

*Strictly NO refund after paying the deposit for Mountain Climbing Trip or Via Ferrata Package.

Tours / Accommodation / All other packages:-
No refund in full or part will be given after the trip has started. No refund in full or part either by choice or circumstances will be given for services included in the itinerary which are not utilized. If it is believed that a refund is appropriate under these terms and conditions (including cancellation by a provider of service) the applicant must request the refund in writing and support the application with appropriate documents, within one month of return home. International refunds can take up to 3 months.

TRAVEL INSURANCE & DOCUMENTATION

We strongly advise that you purchase a comprehensive travel insurance policy to cover all aspects of your holiday including the loss of deposit through cancellation, loss of baggage and personal items, personal injury or death, inclement weather clause, pre-existing medical condition waiver. Borneo Land Adventures Sdn.Bhd. will assist you with the purchase of travel insurance if requested.

Please ensure that you have valid travel documents and appropriate visas (if applicable) prior to arrival.

MEDICAL INFORMATION & SPECIAL REQUESTS

You represent and warrant that you are fit to travel and partake on your selected tours and that your conduct will not impair the safety of or cause any inconvenience to other people on the tour. Any medical condition, special medical requirement, pregnancy, disability and/or dietary request must be reported to Borneo Land Adventures Sdn.Bhd. when making reservation. Medical certificates confirming fitness to travel may be required before the reservation is accepted.

Borneo Land Adventures Sdn.Bhd. reserve the right to decline anyone whose condition, in our opinion, may affect the health and safety of other people on the tour. Best efforts will be made to assist in the provision of any requests or requirements where possible, but we cannot be held liable in relation to the inability to provide such request/requirement, medical, dietary or otherwise.

Due to strenuous physical activity often involved during certain tours and the lack of proper facilities for the disabled, selected itineraries are not recommended for those with physical disabilities. You are advised to take out insurance covering medical treatment.

INCLUDED IN TOUR PRICE

Items and services included for each tour programme are listed in the sections pertaining to that individual tour.

EXCLUDED IN TOUR PRICE

Accident insurance cover, air fares (unless stated in specific itinerary), items of personal nature such as laundry, telephone charges, excess baggage fees and meals (unless stated in specific itinerary), tips to porters, bellman and local guides, hotel parking charges and other items not specifically mentioned as included in the itinerary.

LIABILITY

Borneo Land Adventures Sdn.Bhd. act as agents for some services provided by operators herein and cannot be held liable for any of those providing services listed or any other services incidental thereto. Therefore, all bookings with Borneo Land Adventures Sdn.Bhd. are subject to terms and conditions and limitations imposed by airlines, hoteliers, and other service providers. Baggage and personal effects are your own risks and it is your responsibility to obtain insurance against loss or damage.

Borneo Land Adventures Sdn.Bhd. and the operators involved in any tour shall be exempt from all liability for losses or additional expenses in respect or any detention, delay, loss, damage, sickness, or injury, respective of the cause, including strikes, war, quarantine and whether or not directly or indirectly caused by any service provided or by a service provider, or by any property used or utilized by a service provider.

Borneo Land Adventures Sdn.Bhd. reserve the right to correct any errors, prices or commissions of information prior to final payment being received by Borneo Land Adventures Sdn.Bhd. Prices are only guaranteed upon Final Payment. It is also expressly declared that Borneo Land Adventures Sdn.Bhd. shall have the sole and absolute discretion to decline, accept or retain any person as a member of any tour, to cancel, alter or shorten the duration of any tour in the event of force majeure, hostilities, accident of other circumstances beyond the control of the company which render it necessary in the company’s opinion that such steps be taken. The company should be relieved from all liabilities and obligations whatsoever resulting therefrom.
